Once you have chosen your tenant and received satisfactory references, then you will;
- Ask the tenant to complete the Tenant Application Form to keep for your records
- Need cleared funds preferably by BACS, (avoid cheques where possible), for the first months’ rent and deposit
- Both sign the Assured Shorthold Tenancy (AST) agreement, download the AST Template based on Fosters Landlords copy and download the AST Template based on Fosters Tenants copy
- Give the tenant their copy along with copies of the EPC, Gas Safety Certificate, Electrical Installation Condition Report (EICR) and the How to Rent Guide
- It is advisable to also give the tenant this ELA Privacy Notice for AST addendum to be GDPR compliant
- Take a copy of their passport and driving licence, (Right to Rent Legislation), this needs to be kept until 1 year after the tenancy ends.
- Register the deposit and give them the prescribed information within 30 days of the tenancy commencement. You can register the deposit with DPS, TDS or mydeposits.
- It is advisable to have an inventory of the property done before the tenant moves in. If you would prefer to do this yourself, take lots of photos and you can use these forms Inventory full set
- If you decide to have a guarantor in place for the tenancy use this Guarantor Agreement
The ELA AST states the following and by signing it the tenant agrees that, (amongst other things);
- The tenancy is for a fixed term of 6 months and then lapses to a statutory periodic tenancy
- They are liable to pay rent monthly on the date agreed
- They are liable for all utility bills
- That the deposit can be used against damages and rent arrears (essential to get an inventory done at the start of the tenancy)
- That they are responsible for making sure smoke detectors are in working order
- They have received the EPC, Gas safety certificate, EICR, (Electrical Installation Condition Report), and the How to Rent Guide
